This seminar focuses on issues of particular relevance to owners and licensees of patent applications pertaining to therapeutics. Topics of discussion include:
- (a) the kinds of patents which can be obtained in relation to therapeutics;
- (b) special considerations applicable to therapeutics during patent prosecution;
- (c) an overview of the Patent Medicines (Notice of Compliance) Regulations as well as an explanation as to how the claims of a patent application can be amended in order to ensure that the patent issuing from that application is eligible to benefit from the Regulations;
- (d) the time sensitive critical steps which need to be taken in order to benefit from the protection provided by the Patent Medicines (Notice of Compliance) Regulations;
- (e) eligibility for data protection, and the distinction between data protection and patent protection; and
- (f) the issue of price control by the Patented Medicines Prices Review Board
